Re: Unionwide Grievance - Article 34.13

The FOP is the exclusive representative for police officers at Naval District Washington.

February 9, 2024, the agency improperly notified bargaining unit employees of a schedule changes effective February 25, 2024.

The notification is improper and violates the collective bargaining agreement and federal law as the FOP and the Agency are still in contract negotiations over the proposed schedule change. Nothing has been agreed to by the parties as of yet.

In fact, placing such a notification out prior to the completion of negotiations is evidence of bad faith, bargaining by the agency.

Moreover, the FOP has learned that the agency is requiring employees to sign and acknowledge the proposed schedule change.

This also violates well established, federal law, and the contract as the agency does not have the authority to compel an employee to sign such an agreement. Requiring employees to sign such an agreement constitutes a bypass of the union.

As a remedy, the union a cease-and-desist order, the rescission of the notification, and the posting of a notice to employees and any such further relief as the Arbitrator deems necessary, appropriate, and just.
